A man has filed a suit against a pharmaceutical company, Kenya Revenue Authority and Kenya Bureau of Standards, accusing them of failing to protect Kenyan consumers by branding consignment of a certain brand of condoms with the quality mark of assurance.
The petitioner narrated how he used his favourite brand of condoms, Zoom scented chocolate flavoured studded condoms, believing he would please his sexual partner and protect him fully but unfortunately, it broke during intercourse, reports CitizenTV Kenya.
In his sworn affidavit, he claims that he contracted STI as a result of using the fake condoms which led him to infect his wife who has since left him for infecting her with the STI.
“Whilst I was having sexual intercourse with the woman, the said condom broke — a fact which I only realised after the act.
“That at the time, I brushed the incident as a non-issue and three days later, I still had sexual intercourse with my wife,” he said.
The man also fears that he has been exposed to the HIV virus.
Further, the petitioner claimed that the said product dubbed “The impugned batch” was originally meant to be sold in Uganda but failed all the qualitative tests, leading to the regulatory body in the country declaring it unfit for intended use.
The petitioner now says that following the incident, he suffered a mental breakdown, lost his family and became an alcoholic and subsequently lost his job as a result.
The man claims that he was later told by his friends that some of them had experienced condom breaks from the same brand of condoms.
