Oregun Residents Take Lagos Commissioners To Court Over Illegal Allocation of Canal Setback To Mechanics

Residents of Ibijoke and Olasimbo streets in Ikeja Local Government Area of Lagos State have taken three Lagos State Commissioners to court over Illegal allocation of a canal setback in their area to mechanics, reports thegazellenews.com

In the writ of summons sighted by this medium, the three Commissioners involved are: the Commissioner for Justice and Attorney General of the state; the Commissioner for the Environment; and the Commissioner for Transportation.

The case was instituted by Felix Akinnisola, Esq and Remi Olowolabi of Covenant Villa on behalf of Alhaji Wasiu Lawal and Pastor Kola Olayemi who are standing in for Ibijoke and Olasimbo CDA.

In the statement of claim, the appellants are seeking court declaration that: the removal of the barricade that shields the community from criminal activities, environmental hazards, and pollution by the Commissioners for Transport and the Environment is illegal, unlawful and a breach of their right to live as enshrined the 1999 Constitution as amended; and that the purported allocation of the canal setback beside their community is illegal and unlawful.

The Ibijoke and Olasimbo CDA are therefore seeking the order of the court for the following:

An order setting aside the purported allocation of the canal setback in their community to mechanics; and an order to direct the defendants to restore and erect the protective barricade put in place by the appellants to ward off criminal activities in the area.

The appellants are also seeking perpetual injunction on defendants to: stop allocation of the canal setback to mechanics; and a perpetual injunction to stop removal of the protective barricade put in place by the appellants.

The appellants are also seeking payment of N5 million as damages to them.

The defendants have been given 42 days to file their counter claims on the matter and case with suit number ID/1103GCM10/2024.

Despite being served the Writ of Summon, none of the defendants has responded to any of the issues raised in the case at the time of writing this report.
