{"id":14319,"date":"2023-07-14T08:04:41","date_gmt":"2023-07-14T08:04:41","guid":{"rendered":"https:\/\/theblogonline.com\/?p=14319"},"modified":"2023-07-14T08:08:57","modified_gmt":"2023-07-14T08:08:57","slug":"ccpt-slams-n120m-fine-on-stanbic-ibtc","status":"publish","type":"post","link":"https:\/\/theblogonline.com\/?p=14319","title":{"rendered":"CCPT Slams N120m Fine On Stanbic-IBTC Bank"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">The <a href=\"https:\/\/ccpt.gov.ng\/\" rel=\"nofollow noopener\" target=\"_blank\">Competition and Consumer Protection Tribunal<\/a> (CCPT), sitting in Abuja on Thursday, imposed a fine of N120 million against\u00a0 <a href=\"https:\/\/www.stanbicibtcbank.com\/nigeriabank\/personal\" rel=\"nofollow noopener\" target=\"_blank\">Stanbic-IBTC Bank<\/a> over the bank\u2019s failure to complete a transfer request for a customer.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In a split decision of two to one, the tribunal convicted the bank for contravening the provisions of Section 130(1)(a) of the FCCP Act, 2018 and Section 5(2)(8) and (9) of the Central Bank of Nigeria Regulation on Instant Interbank Electronic Transfers.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The tribunal said the fine was imposed due to the <a href=\"https:\/\/www.stanbicibtcbank.com\/nigeriabank\/personal\" rel=\"nofollow noopener\" target=\"_blank\">bank<\/a>\u2019s failure\u00a0to comply with the 10 minutes or at most one hour mandatory timeline for failed transfers to be reversed as provided by Sections 154 and 155 of the FCCP Act, 2018.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The lead judgement delivered by Hon. Sola Salako-Ajulo also ordered the bank to pay the claimant, Mr Clement Osuya, the sum of N1 million as cost of filing the action.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe tribunal holds that in as much as the defendant (<a href=\"https:\/\/www.stanbicibtcbank.com\/nigeriabank\/personal\" rel=\"nofollow noopener\" target=\"_blank\">IBTC<\/a>) failed to comply with the two instructions of the claimant to transfer the sums of N500,000 to another account in Access Bank, as no transfer took place at both times, defines that the defendant breached the banker-customer contractual relationship between the two parties,\u201d Ajulo said.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The tribunal, however , refused to award the sum of N5 million to Osuya as compensation on the grounds that he failed to prove any injury he suffered as a result of the failure of service delivery by the bank.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Hon. Ibrahim Yakubu concurred with the verdict of Salako-Ajulo while the presiding judge, Hon. Chuma Mbonu disagreed and gave a minority judgment.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Mbonu in his minority judgment held that the tribunal lacked the jurisdiction to entertain the petition.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">According to him, the tribunal has the powers of appellate jurisdiction and not of original jurisdiction and he consequently struck the suit out for lacking in merit.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It could be reports that Osuya had filed a petition against the bank\u00a0 challenging the failure of the bank on two occasions to transfer the sum of N500,000 from his IBTC account to his Access bank account.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He claimed that the money was for the payment of school fees for his children.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He told the tribunal that on Sept. 8, 2022, he filled out a form under NIS Instant Payment option for a transfer of the sum of N500, 000 to his Access Bank account.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He held that whereas the money, on both occasions left his IBTC account as the account was debited,\u00a0 it never arrived his Access bank account because it was not credited.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Osuya told the tribunal that reversal on the first transaction was done after 24 hours while that of the second transaction was reversed after 72 hours.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He further alleged that this neglect of duty of care by the bank caused him trauma, embarrassment and a dent in his reputation as he was forced to collect a loan.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The bank, through its counsel, Mr Marcel Osigbemhe had blamed the failure of the transaction on the third-party NIPS service.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Osigbemhe,in a brief remark\u00a0 expressed his displeasure over the judgment, saying he wondered how his client could be convicted when there were clearly no charges brought against it.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Counsel to the claimant, Ms Deborah Solomon, for her part thanked the Tribunal for the well considered judgment.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The fine is to be paid into the tribunal\u2019s remitta account.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Competition and Consumer Protection Tribunal (CCPT), sitting in Abuja on Thursday, imposed a fine of N120 million against  Stanbic-IBTC Bank over the bank\u2019s failure to complete a transfer request for a customer.<\/p>\n","protected":false},"author":1,"featured_media":14320,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2456],"tags":[7259,3994],"class_list":["post-14319","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-business","tag-ccpt","tag-stanbic-ibtc"],"_links":{"self":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14319"}],"collection":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=14319"}],"version-history":[{"count":2,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14319\/revisions"}],"predecessor-version":[{"id":14322,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14319\/revisions\/14322"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/media\/14320"}],"wp:attachment":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=14319"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=14319"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=14319"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
