{"id":14298,"date":"2023-07-12T12:31:11","date_gmt":"2023-07-12T12:31:11","guid":{"rendered":"https:\/\/theblogonline.com\/?p=14298"},"modified":"2023-07-12T12:31:11","modified_gmt":"2023-07-12T12:31:11","slug":"sanwo-olu-present-sole-witness-dibal-in-defence-of-jandors-petition","status":"publish","type":"post","link":"https:\/\/theblogonline.com\/?p=14298","title":{"rendered":"Sanwo-Olu, Hamzat Present Sole Witness Dibal In Defence Of Jandor\u2019s Petition"},"content":{"rendered":"<p class=\"p1\">Lagos State Governor, Babajide SanwoOlu and his deputy, Obafemi Hamzat on Tuesday presented their sole witness, Adamu Shettima Yuguda Dibal at the Governorship Election Petitions Tribunal in their defence of the petition filed by the People\u2019s Democratic Party (PDP) candidate, Dr. Olajide Adediran popularly known as Jandor.<\/p>\n<p class=\"p1\"><span class=\"s1\">Dibal is a former Borno State Deputy Governor who chaired the Lagos State governorship primary election of the All Progressives Congress (APC) on May 26, 2022 which produced Sanwo-Olu as the candidate.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He told the three-member tribunal headed by Justice Arum Ashom that the Lagos State APC Chairman, Cornelius Ojelabi did not flout any electoral regulation when he wrote to the state chapter of the Independent National Electoral Commission (INEC) to notify it of the party\u2019s primary election.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the petition filed by Adediran and his party, the PDP, the petitioners listed two grounds of appeal to the effect that Sanwo-Olu and Hamzat were at the time of the election not qualified to contest.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Adediran also stated that the governorship candidate of the Labour Party, Gbadebo Rhodes-Vivour who was declared by the 1st respondent, INEC as having scored the second highest number of votes was, at the time of the election also not qualified to contest.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The PDP governorship candidate said he is calling for the disqualification of the All Progressives Congress (APC) and the Labour Party (LP) candidates in the election for \u201cnon-compliance\u201d with the Electoral Act 2022 as well as the guidelines of the Independent National Electoral Commission (INEC).<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He had also alleged that the governor presented a forged WAEC certificate to INEC.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The petitioner also accused Hazmat of swearing allegiance to another country and not including his oath of declaration in his INEC Nomination Form (EC9), and that the APC did not comply with the Electoral Act when nominating both men.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The petitioner who emerged third in the election, closed his petition last week after presenting oral and documentary evidence.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">INEC, who is the first respondent, has also closed its defence in the petition.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Sanwo-Olu, Hamzat, APC; Rhodes-Vivour, and the LP are listed as the 2nd, 3rd, 4th, 5th, and 6th respondent respectively.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">At the resumption of proceedings Tuesday, the counsel representing Governor Sanwo-Olu and his deputy, Bode Olanipekun (SAN) presented his sole witness, Adamu Dibal.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">he witness defended the conduct of the APC primaries before the three-member tribunal led by Justice Ashom.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Under cross-examination, counsel to the PDP\u2019s candidate, Clement Onwuenwunor (SAN), asked the witness whether Ojelabi was the national chairman of the APC as of May 24 when he authored the letter to INEC notifying it of the party\u2019s primary election. The witness answered in the negative.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Mr Dibal was also asked whether, \u201cBy APC\u2019s guidelines, it is the national or state office that conducts a governorship primary election?\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The witness said it is the \u201cNational Working Committee that sets up the states\u2019 committees who will then conduct the primary election in all the 36 states.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">While answering questions under cross-examination from the APC counsel, Babatunde Ogala (SAN), Dibal after being shown the said letter which is now an exhibit before the tribunal, explained that Mr Ojelabi was only informing the INEC Lagos office that the NWC had constituted a five-member committee to conduct the primary, in which he (the witness) was the chairman.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He also said he produced a report on the primary election to the national secretariat of the APC after the exercise.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Mr Ogala asked,<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cIs that a copy of the report marked as p139-144?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">-Yes<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">And it was signed by all members of the committee?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">-Yes<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Was it a unanimous agreement by all members?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">-Yes.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In another round of cross-examination by INEC\u2019s counsel, Adetunji Oyeyipo (SAN), Mr Dibal said representatives from INEC\u2019s headquarters and its Lagos office were present during the primary election, and that they signed a report on its conduct afterwards.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cWere officers from INEC headquarters and the state office present at the primary?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u2013 Yes, they were<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">And they all signed the report?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u2013 Yes<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Look at the portion signed by INEC Lagos, who led the team?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">-Akanni Gabriel Abidakun.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">There was no cross-examination by counsel representing the Labour Party candidate, Gbadebo Rhodes-Vivour.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The tribunal thereafter discharged the witness, and subsequently adjourned to Wednesday, July 12 for the APC to open its defence.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lagos State Governor, Babajide SanwoOlu and his deputy, Obafemi Hamzat on Tuesday presented their sole witness, Adamu Shettima Yuguda Dibal at the Governorship Election Petitions Tribunal in their defence of the petition filed by the People\u2019s Democratic Party (PDP) candidate, Dr. Olajide Adediran popularly known as Jandor.<\/p>\n","protected":false},"author":1,"featured_media":14299,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[1652,3262,7248],"class_list":["post-14298","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-politics","tag-babajide-sanwo-olu","tag-jandor","tag-sole-witness"],"_links":{"self":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14298"}],"collection":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=14298"}],"version-history":[{"count":1,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14298\/revisions"}],"predecessor-version":[{"id":14300,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/posts\/14298\/revisions\/14300"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=\/wp\/v2\/media\/14299"}],"wp:attachment":[{"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=14298"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=14298"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/theblogonline.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=14298"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
